HomeMy WebLinkAboutR-2019-016 City Approving the Site Plan (SP-80-18) Submitted by Dania Live 1748, LLC for Property Generally Located on the North Side of Stirling Road Between Bryan Road & Interstate 95 RESOLUTION NO. 2019-016 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN (SP-80-18) SUBMITTED BY DANIA LIVE 1748, LLC FOR PROPERTY GENERALLY LOCATED ON THE NORTH SIDE OF STIRLING ROAD BETWEEN BRYAN ROAD AND INTERSTATE 95 WITHIN THE CITY OF DANIA BEACH, FLORIDA, AS LEGALLY DESCRIBED IN EXHIBIT "A", A COPY OF WHICH IS ATTACHED TO THIS RESOLUTION; PROVIDING FOR CONFLICTS; AND FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Chapter 28, Part 6 "Development Review Procedures and Requirements" of the Dania Beach Land Development Code (the "Land Development Code"), Article 635 "Site Plans," and Article 340 "Planned Mixed-Use Development District (PMUD)," Section 340-40 "Design Development Guidelines (DDG)," provides that site plan approval is required as a condition to the issuance of a building permit; and WHEREAS, LDC Article 340 "Planned Mixed-Use Development District (PMUD)," Section 340-30(S) "Site plan approval," provides that site development shall comply with the established PMUD regulations and the approved DDG; and WHEREAS, Dania Live 1748, LLC (the "Applicant") is requesting Site Plan approval to permit the development of additional areas of Dania Pointe Phase II, consisting of 452,763 square feet of office space to be located at the northwest corner of Stirling Road and Bryan Road in the City, as legally described in Exhibit"A"; and WHEREAS, the City Commission conducted a duly noticed public hearing in accordance with Article 610 of the Land Development Code; and WHEREAS,the City Commission finds that the approval of the proposed Site Plan(SP- 80-18) will protect the public health, safety, and welfare of the residents of the City, and furthers the purpose, goals, objectives and policies of the Comprehensive Plan. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the foregoing "WHEREAS" clauses are ratified and confirmed as being true and correct, and they are made a part of and incorporated into this Resolution by reference. Section 2. That pursuant to Chapter 28, "Land Development Code", Part 6 "Development Review Procedures and Requirements," Article 635 "Site Plan," Article 340 "Planned Mixed-Use Development District(PMUD)," and Section 340-40 "Development Design Guidelines (DDG),"the following Site Plan(SP-80-18), attached as Exhibit `B" which is made a part of and incorporated into this Resolution by reference is approved subject to the following conditions: 1. Additional Fire Department Access Information as follows: a. Fire Lane locations and striping detail (demonstrated) b. "NO PARKING" sign locations and sign details demonstrated c. Fire Department Access Routes During Construction(BSO Fire). 2. Additional Water Supply Information as follows: a. Provide locations of hose connections in parking garage (BSO Fire). 3. Address Detail (BSO Fire). 4. An egress plan demonstrating and dimensioning all common paths of travel and travel distances to all exits within the buildings and/or structures (BSO Fire). 5. Minimum Radio Signal Strength for Fire Department Communications — See details on the next page (BSO Fire). 6. Provide copies of latest approved onsite drainage system plan along with storm-water management calculations (signed and sealed by a registered professional engineer). The calculations shall show how the minimum road crown and the finished floor elevations are met, and how the 25 year, 3 day storm event is maintained on site with zero discharge to the ROW and adjacent properties. The site must store at least the 25-year, 3 day event on site with no exceptions (Engineering). 7. Provide a copy of approved pre —and- post development storm-water management and drainage calculations and geotechnical report supporting the proposed drainage design. The City specifically needs the following information: 5 year -1 hour, 5-year 24 hour, 10- year 24 Hour, 25-year and 100-year72-hour flood stage elevations (Engineering). 8. Storm-water quality design shall be provided in the amount of 2.5 inches times the percent impervious or the first 1 inch of rainfall over the entire site whichever is greater (Engineering). 9. Provide utility piping conflict details plan, along with documentation to demonstrate acceptability of the separation between water, sanitary, storm-water service lines (Engineering). 2 RESOLUTION#2019-016 10. Provide copies regulatory agencies' approval documentation as part of the final submittal (Broward County Surface Water License, Broward County Health Department Permit, etc.). Provide copies of approved permits from FDOT, City of Dania Beach, Broward County, EPD and others for utilities and driveway(s) connections (As applicable) (Engineering). 11. Show how roof drainage is collected (Engineering). 12. Provide a complete Water and Sewer — Utility Plan, indicating all water and sewer appurtenances including but not limited to point of connection to the existing system, cleanout, water meter, check valve, etc. including any existing water main, force mains, gravity mains, etc. (Show all material &pipe sizes on the plan). Water meters, Back flow preventers, RPZ, DDCV, etc. pending to be identified (Engineering). 13. Provide a complete Pavement, Marking and Signage Plan with details (Engineering). 14. In signage and marking plan —Site Plan-. Identify dimensions of Proposed Monument signs (Engineering). 15. In Signage and marking plan-Site Plan-, include the radii (Engineering). 16. Provide copy of approved Traffic Study(Engineering). 17. Provide an Erosion and Sediment Control Plan shall be reviewed for the drainage impacts to adjacent properties, surrounding ROW, storm-water facilities, and neighboring water bodies (Engineering). 18. Provide silt fence applications, protection around inlets or similar structures, barrier for fill slope, barrier for paved and unpaved ditches details (As applicable) (Engineering). 19. Contractor shall provide, before issuance of C.O., to the FOR and City of Dania Beach a CD with hard copies of "As-Built" drawings of the project giving all civil work information but not limited to horizontal and vertical elevations, dimensions, grading of paving and drainage, water, and sewer connections, etc. signed and sealed by a certified registered surveyor(Engineering). 20. Per Sec. 275-80: G) Provide a landscape calculations table that indicates required quantities and provided quantities for each separate code requirement. Include the code section for each category; H) Plant material listed according to corresponding code requirement, gross and net acreage, and square footage of vehicular use areas; and M) Provide an irrigation plan that addresses the details outlined in the Code(Landscape). 3 RESOLUTION#2019-016 21. Provide the number of shade, intermediate, small, and palm trees in each of the four categories per Sec. 275-190. Sec. 275-190(D) requires a minimum percentage of total trees whereas Sec. 275-190(E-G) requires a maximum percentage of total trees/palms (Landscape). 22. Specifications for proposed tree diameters are listed in caliper. Provide the diameter specification in diameter at breast height (DBH) to show Sec. 275-190 minimum DBH requirements are being met for each respective tree category for consistency with the City's code (Landscape). 23. It appears there are several electrical equipment structures along the north and south perimeters of the site. Please provide screening for these structures per Sec. 275-170(B) (Landscape). 24. Note that Green Island Ficus and Malayan Coconut Palms are category 1 & 2 invasive species (respectively) on the most recent (2017) FLEPPC list. Per Sec. 275-190(I)(9) of the Dania Beach Code of Ordinances and Sec (8)(8)1. of the Dania Pointe Development Design Guidelines and Development Standards, all plants identified as category 1 and 2 invasive species under Sec. 825-50 are prohibited (Landscape). 25. Ensure minimum spacing requirements for all trees and palms per Sec. 275-190(H) are met. Provide notes or dimensions where applicable (Landscape). 26. Provide the total VUA (in square feet), VUA dedicated to landscaping (in square feet), and the percentage of the VUA dedicated to landscaping per Sec. 275-100(B) (Landscape). 27. Include the City of Dania Beach standard landscape notes (attached) on the next submitted plan(Landscape). 28. APPLICATION: Per LDC, Section 635-50, Site Plan submittal must provide the following information that is missing with this submittal. • (S) Location, character, size, height and orientation of proposed signs, including building signage details shown on plan elevations and method of illumination. 29. SIGNS: • Monument Sign—provide dimensions, number proposed and proposed location to confirm compliance with DDG and LDC. • Wayfinding Sign — Confirm "Wayfinding' is the same as "Vehicular Directional Signage", as the DDG does not identify "Wayfinding" signage. Provide dimensions, number proposed and proposed location to confirm compliance with DDG and LDC (Planning). 4 RESOLUTION#2019-016 30. RAC TRAFFIC IMPACT MITIGATION: Per Traffic Statement by KimleyHorn dated November 14, 2018, 586 PM peak hour trips will be generated. Therefore the RAC Traffic Impact Mitigation fee due at time of permit will be $12,458.36 (586 X 21.26) (Planning). 31. Revise the shadow study to show how far the shadow project east for Winter and Fall at 5:00 (Planning). 32. Per 0-2017-022, for properties over an acre in size, the applicant must obtain and post property signs in accordance with the NEW City requirements. Please see the end of this document for guidelines (Planning). 33. Per 0-2017-027, commercial properties under construction are required to provide security to fencing with screening showing project rendering when adjacent to ROW. Provide screen detail with next submittal (Planning). Section 3. That pursuant to Section 14 "Site Plan Submittals" of the Dania Pointe PMUD Design Development Guidelines, the Site Plan (SP-80-18) approval shall automatically expire and become null and void five (5) years from the effective date of this Resolution unless the Applicant files a complete building permit application and secures approval of building permits for the improvements shown on the Site Plan within the five (5) year time frame, unless an extension is granted by the City Commission. Section 4. That the issuance of a development permit by a municipality does not in any way create any right on the part of an Applicant to obtain a permit from a state or federal agency, and does not create any liability on the part of the municipality for issuance of the permit if the Applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal agency, or undertakes actions that result in a violation of state or federal law. Section 5. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 6.
