HomeMy WebLinkAboutR-2019-019 City Approving (SP-29-18) Request, Assignment of Flex Acreage (OT-32-18) Request, Parking Variance Request (VA-30-18), Landscape Variance Request (VA-31-18), & Loading Area (VA-75-18) RESOLUTION NO. 2019-019 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN (SP-29-18) REQUEST, ASSIGNMENT OF FLEX ACREAGE (OT-32-18) REQUEST, PARKING VARIANCE REQUEST(VA-30-18),LANDSCAPE VARIANCE REQUEST(VA- 31-18),AND LOADING AREA VARIANCE REQUEST(VA-75-18)SUBMITTED BY RAHIL SANGHVI ON BEHALF OF DANIA RESORTS, LLC FOR PROPERTY GENERALLY LOCATED ON THE SOUTH SIDE OF STATE ROAD 84 AND NORTH OF I-595 WITHIN THE CITY OF DANIA BEACH,FLORIDA, AS LEGALLY DESCRIBED IN EXHIBIT"A;"PROVIDING FOR CONFLICTS; AND FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,The City Code of Ordinances,Chapter 28,entitled"Land Development Code" (the"LDC"),of Part 6,entitled"Development Review Procedures and Requirements,"Article 635, entitled "Site Plans," states that Site Plan approval is required as a condition to the issuance of a building permit; and WHEREAS, Rahil Sanghvi on behalf of Dania Resorts, LLC (the "Applicant") has requested Site Plan approval(SP-29-18)to permit the development of a 103-room hotel for property located at 3001 SW 26th Terrace (the "Property") as legally described in Exhibit"A;" and WHEREAS, the Applicant has requested Assignment of Flex Acreage from Industrial to Commercial for the Property; and WHEREAS,Chapter 28,Part 6 of the LDC,Article 625,entitled"Variances,"Section 625- 40, entitled"Variance Review Criteria; City Action," states that the City Commission may grant a Variance based on its determination that the Applicant has demonstrated that the necessary criteria identified in the LDC have been satisfied; and WHEREAS, the Applicant has requested a Variance to permit a five (5) foot landscape buffer around the building and a five(5)foot perimeter buffer around the Property perimeter,where the LDC requires a ten(10)foot wide landscape buffer around the building,pursuant to Section 275- 100(E) and a ten(10) foot property perimeter buffer,pursuant to Section 275-120; and WHEREAS,the Applicant has requested a Variance to permit a reduction in parking spaces to 90 spaces, where the LDC requires 101 parking spaces,pursuant to Section 265-50; and WHEREAS,the Applicant has requested a Variance to remove the loading dock area,where the LDC requires a 12 foot by 25 foot loading dock area,pursuant to Section 270-20; and WHEREAS,the City Commission conducted a duly noticed public hearing in accordance with Article 610 of the LDC; and WHEREAS,the City Commission finds that the approval of the proposed Site Plan(SP-29- 18),Assignment of Flex Acreage from Industrial to Commercial(OT-32-18),Parking Variance(VA- 30-18), Landscape Variance(VA-31-18), and Loading Area Variance(VA-75-18) will protect the public health, safety, and welfare of the residents of the City, and furthers the purpose, goals, objectives, and policies of the Comprehensive Plan. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the foregoing"WHEREAS"clauses are ratified and confirmed as being true and correct and they are made a part of and incorporated into this Resolution by reference. Section 2. That pursuant to Chapter 28"Land Development Code,"Part 6"Development Review Procedures and Requirements,"Article 635 "Site Plan,"the following Site Plan(SP-29-18), attached as Exhibit`B" is approved. Section 3. That concurrent to and consistent with the approved Site Plan(SP-29-18), attached as Exhibit`B",the assignment of Flex Acreage(OT-32-18)from Industrial to Commercial for the Property is approved. Section 4. That pursuant to Chapter 28"Land Development Code,"Part 6"Development Review Procedures and Requirements," Article 625 "Variances," the following Variance applications (VA-30-18, VA-31-18, and VA-75-18) are approved consistent with the Site Plan provided in Exhibit`B." Section 5. That the approvals granted by this Resolution are subject to the Applicant's compliance with the following conditions: 1. The proximity to the airport will require FAA review and approval. Contact William Castillo,Airport Planner with Broward County Aviation Department,located at 2200 SW 45 Street, Suite 101, Dania Beach, FL 33315, (954) 359-6100. Contact Greg Jones, Airspace and Land Use Manager with FDOT at 850-414-4502 or at greg.jones@dot.state.fl.us. 2. PLATTING: Provide letter from Broward County Planning Council stating no need to plat/replat property. Needed prior to Public Hearing. (Zoning) 3. Provide minimum bicycle parking requirements identified in Section 265-51. 10% of required vehicular parking is required in bicycle parking. In this case 10%required parking = 11 bike parking required. Identify in site data table and show location on site plan drawing. 2nd time requested, you may request a variance but this cannot proceed to Public Hearing until addressed. (Zoning) 2 RESOLUTION#2019-019 4. ROOFTOP MECHANICAL EQUIPMENT: Must meet regulations in Section 220-60. Identify how equipment will be screened from view. (Zoning) 5. Per 0-2017-027,commercial properties under construction are required to provide security to fencing with screening showing project rendering when adjacent to ROW. Provide screen detail with next submittal. (Zoning) 6. Clearly identify location of property lines on survey. 2nd time requested. (Zoning) 7. Show location of NVAL on site plan drawing to ensure driveways are in proper location.2nd time requested. (Zoning) 8. Identify location on site plan of 15' billboard and access easement as shown on survey, as easement must be free of structures and parking. 2nd time requested. (Zoning) 9. Per Section 265-110(H)(1)provide wheel stops 5.5"high,2'from front parking space. Show on site plan and provide detail. (Zoning) 10. Per Section 265-110(H)(2)the perimeter of VUA must have a 6"raised type"D"or"F"curb (non-extruded). Show on site plan and provide details. (Zoning) 11. Per Section 265-150(E) minimum access width at street is 25'. Identify on site plan. (Zoning) 12. Per Section 290-40 Maximum dumpster enclosure height is 7'. Revise accordingly.2nd time requested. (Zoning) 13. Per Section 290-50(B) must provide pedestrian maze-style access. Show on site plan and provide detail. 2nd time requested. (Zoning) 14. Provide typical cross-sections and section profiles along all property lines,and show how the existing and proposed grades will tie top one another. Also, show spot elevations and the perimeter(property lines) on the Paving and Grading Plan. Double Section A and Missing Section B on Grading Plan C-3. Sections on C-6 must show elevations and slope at swales showing rainwater is retained on site. Grading Spots are missing showing rainwater flowing into catch basin. Still double Section A are shown on C-3 and Section B is missing on Plan. It is not found a Berm at 6.64' on Sections. (Engineering) 15. Entire property including driveway aprons and swales must be graded such that rainwater is contained within property and not in the FDOT, BCHCED and/or City ROW and/or neighboring properties.Revise Section A on C-6 swale slopes,rainwater is not contained on site."The 25-3 day storm berm is offset from the property line due to the elevation difference between the road and property. As such, we are asking for an exemption." This condition shall be revised by Zoning and the City Engineer. (Engineering) 16. Water and Sewer—Utilities- Plan, including any existing water main, force mains, gravity, mains, etc. (Show all material & pipe sizes on the plan). Please be advised that all water- main shall be constructed with DIP piping in the City ROW.Utility Plan was provided.Loop of 8"DIP Water main off 15' Utility easement. Verify, size of existing WM along SW 26th Terrace 8"X 8"Wet Tap Sleeve and 2"Corp. Stop."The Tapped connection shall be at least one nominal size smaller than the diameter of the pipe being tapped"."Tapping Sleeves shall be installed at least 4-feet from any exposed joint or existing tap". Must have approval of Public Services—City Engineer."Utility plan has been revised showing the Wet Tap Sleeve to be done on the existing 16"WM. The current utility easement falls within the landscape boundary and we are willing to modify the easements accordingly." (Engineering) 17. Provide a proposed water and sewer — utilities — plan, indicating all water and sewer appurtenances including but not limited to point of connection to the existing system, 3 RESOLUTION#2019-019 cleanout, water meter, check valve, etc. Utility Plan was provided. Loop of 8" DIP Water main off 15' Utility easement. Verify, size of existing WM along SW 26th Terrace 8"X 8" Wet Tap Sleeve and 2" Corp. Stop. "Utility plan has been revised accordingly." (Engineering) 18. Provide utility piping conflict plan,along with documentation to demonstrate acceptability of the separation between water, sanitary, storm-water service lines. (Engineering) 19. Meet with Public Services, separately, to discuss water and sewer connections. Request meeting through the City Eng. Pending to be requested. "Meeting has been requested via e- mail. Waiting on the response, if meeting is necessary." Pending to be addressed. (Engineering) 20. Additional Fire Department Access Information as follows: (Fire) a. Fire Lane locations and striping detail (demonstrated) b. "NO PARKING" sign locations and sign details demonstrated c. A note or detail identifying the design load for surface compaction of all non-paved roadways and/or Fire Department Access Roads (where applicable) d. Building Accessibility e. Load Limits for Bridges and Grading for significant changes in elevation (if applicable) f. Fire Department Access Routes During Construction 21. Additional Water Supply Information as follows: (Fire) a. Locations of all Post Indicating Valves or Underground Gate Valves, Double Detector Check Valves, etc. 22. A detail sheet accompanying the Civil Plans with the following details: (Fire) a. Bollard/Impact Protection Detail for Hydrants, FDC's &DDCV's b. Roadway Pavement Marker (RPM) Detail for Fire Hydrant Locations (Blue Reflective Markers) c. Post Indicating Valve Detail (where applicable) d. Underground Gate Valve Detail (where applicable) e. Backflow Preventer / Double Detector Check Valve (DDCV) Detail (where applicable)that identifies the DDCV as being listed for Fire Use f. Signage Detail for the Fire Department Connections (where applicable) 23. Address Detail (Fire) 24. An egress plan demonstrating and dimensioning all common paths of travel and travel distances to all exits within the buildings and/or structures. (Fire) 25. Minimum Radio Signal Strength for Fire Department Communications—See details on the next page. (Fire) Section 6. That pursuant to LDC Section 635-100"Expiration of Site Plans,"and Section 625-50 "Expiration of Variances," the Site Plan (SP-29-18), Flex Assignment (OT-32-18), and Variances(VA-30-18,VA-31-18,and VA-75-18) approvals shall automatically expire and become null and void unless the Applicant files a complete building permit application with construction drawings for the improvements shown on the Site Plan,within eighteen(18)months from the date of this Resolution. 4 RESOLUTION#2019-019 Section 7. That the issuance of a development permit by a municipality does not in any way create any right on the part of an Applicant to obtain a permit from a state or federal agency,and does not create any liability on the part of the municipality for issuance of the permit if the Applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal agency, or undertakes actions that result in a violation of state or federal law. Section 8. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 9. That this Resolution shall be in force and take effect immediately upon its passage and adoption. PASSED AND ADOPTED on February 26, 2019.
