HomeMy WebLinkAboutR-2025-007 Temporary Access Agreement with Broward County for The Shore Protection Project, Segment III.RESOLUTION NO. 2025-007 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE ENTRY INTO A TEMPORARY ACCESS AGREEMENT WITH BROWARD COUNTY FOR THE SHORE PROTECTION PROJECT, SEGMENT III; PROVIDING FOR NO BUDGETARY IMPACT AS THE AGREEMENT INVOLVES NO COST TO THE CITY; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City is the owner of the coastal resources located at the beach and shoreline, and the owner of the property at the Public Services Yard; and WHEREAS, the Florida Department of Environmental Protection issued the “Shore Protection Project, Segment III” to perform beach tilling and escarpment removal to renourish and restore Broward County beaches, as administered by Broward County; and WHEREAS, Broward County desires temporary access on, over, across, and through the City’s coastal property to facilitate beach restoration, and access to the Public Services Yard for equipment staging; and WHEREAS, the Public Services Department recommends approval to enter into a Temporary Access Agreement for the Shore Protection Project, Segment III identified in “Exhibit A” and the Agreement is made a part of and incorporated into this Resolution by this reference. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the above “Whereas” clauses are ratified and confirmed, and they are made a part of and incorporated into this Resolution by this reference. Section 2. That the proper City officials are authorized to execute an Agreement on behalf of the City of Dania Beach, Florida with Broward County to provide beach restoration. Section 3. That there is no financial commitment from the City for this Agreement. Section 4. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 5. That this Resolution shall be effective 10 days after passage.
