Change Order No. 2 for CW Thomas Muck MitigationRESOLUTION NO. 2025-015 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE USE OF CITY CONTINGENCY FUNDS FOR CHANGE ORDER NO. 2 RELATING TO REQUEST FOR QUALIFICATIONS (“RFQ”) NO. 21-024 “CONSTRUCTION MANAGEMENT AT RISK SERVICES”, FOR CONSTRUCTION OF IMPROVEMENTS AT C.W. THOMAS PARK WITH BURKHARDT CONSTRUCTION, INC., FOR AN AMOUNT NOT TO EXCEED ONE HUNDRED TWENTY THOUSAND SEVEN HUNDRED AND TWO DOLLARS AND SEVENTY-FIVE CENTS ($120,702.75), UTILIZING THE APPROVED CONTINGENCY UNDER AUTHORIZED UNDER RESOLUTION 2024-042; AND AUTHORIZING THE CITY MANAGER TO APPROVE FUTURE CHANGE ORDERS RELATED TO THE PROJECT PROVIDED THEY ARE WITHIN THE $1,000,000, APPROVED CONTINGENCY UNDER RESOLUTION 2024-042; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Burkhardt Construction, Inc. was awarded the contract under RFQ No. 21- 024 for the Guaranteed Maximum Price (GMP) in the amount of Twenty-One Million Three Hundred Fifty-Four Thousand Three Hundred and Twenty-Two Dollars and Thirty-Five Cents ($21,354,322.54) via Resolution 2024-042, which included an Owner’s Contingency fund in the amount of Three Hundred Sixty Thousand Dollars ($360,000.00); and WHEREAS, via Resolution 2024-042, the City Commission authorized One Million Dollars ($1,000,000.00) in additional City contingency funds for unforeseen project costs and/or modifications to the project scope not included in the GMP contract; and WHEREAS, initial soils exploration on the site indicated the presence of subterranean organic muck and upon further exploration of the site once building began, it was discovered that the muck is extensive throughout the site, which needs to be mitigated to extend the lifespan of the improvements and to lessen the frequency for future repairs; and WHEREAS, Burkhardt Construction, Inc. has submitted Change Order 2, which is attached as Exhibit “A” to this Resolution and incorporated by this reference, for the Site Muck Mitigation in the amount of One Hundred Twenty Thousand Seven Hundred and Two Dollars and Seventy-Five Cents ($120,702.75); and WHEREAS, the project architect, Bermello Ajamil & Partners, has provided a letter supporting the muck mitigation change order, recommending the use of additional City contingency funds for this cost, which was specifically excluded from the GMP contract; and 2 RESOLUTION #2025-015 WHEREAS, the City Administration recommends that the City Commission authorize the proper City officials to execute Change Order 2, attached as Exhibit “A” and incorporated by this reference, with Burkhardt Construction, Inc. for the C.W. Thomas Site Muck Mitigation in the amount of $120,702.75. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the above “Whereas” clauses are ratified and confirmed, and they are made a part of and incorporated into this Resolution by this reference. Section 2. That the City Commission authorizes the proper City officials to execute Change Order 2 with Burkhardt Construction, Inc. for the C.W. Thomas Site Muck Mitigation in the amount of $120,702.75. Section 3. That the City shall use its $1,000,000.00 in additional contingency funds for Change Order 2, as approved under Resolution 2024-042. Section 4. That the City Commission authorizes the City Manager to approve future change orders related to the project provided they are within the GMP contract amount, or the remainder of the additional $1,000,000.00 City contingency approved via Resolution 2024-042. Section 5. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 6. That this Resolution shall be effective 10 days after passage. PASSED AND ADOPTED on January 28, 2025.
