AGENDA, OR WHO OTHERWISE WANT TO ADDRESS THE CITY COMMISSION, MUST FIRST BE REGISTERED WITH THE CITY

Addressing the Commission: A thirty (30) minute "Citizen Comments" period shall be designated on the agenda for citizens and interested
persons to speak on matters whether or not scheduled on that day's agenda. Individuals wishing to speak on a matter not included on the
"Public Hearing" section of the agenda, which matter pertains to an item before the City Commission which requires a decision of the City
Commission, may do so by signing in and submitting a form to that effect with the City Clerk prior to the meeting. Speakers at Public
Hearings shall also submit such a form. Each speaker shall be limited to 3 minutes for his or her comments. If more than ten (10) speakers
express a desire to speak, the Commission shall determine on a meeting by meeting basis whether to (a) extend the time allotted for citizen

SUBJECT: Special Event Application Request: Moonlight Car Show (Dania Beach Lions
Club), MLK Parade & Celebration (MLK Committee), and BlueRidge Tree Farm
(Kevin Blakeman)
Request:
A Special Event is requested by Dania Beach Lions Club to host the Moonlight Car Show
beginning on Saturday, March 22, 2025 at City Hall from 6 PM to 10 PM.
A Special Events is requested from the MLK Renaissance Corp to host their annual Martin
Luther King, Jr. Community Celebration Parade & Picnic on Monday, January 20, 2025, from
7:00 AM – 5:00 PM going from CW Thomas Park to Frost Park.
A Special Event is requested by Kevin Blakeman on behalf of Blue Ridge Tree Farm to host
their annual holiday tree sale beginning Wednesday, November 20, 2024, through Tuesday,
December 24, 2024.
Background:
MOONLIGHT CAR SHOW:
"The Dania Beach Lions Club is asking for your support as they develop their plans for the
recently acquired SPOT Vision Testing equipment. Greg Davenport, introduced our SPOT
Vision initiative at the August 27th Commission Meeting. Since that presentation, the SPOT
Vision Team, in conjunction with the Broward Public School System Health Assessment nurses
visited Attucks Middle School and Collins Elementary to screen students vision. The SPOT
Vision team has created an outreach plan to include additional schools in our community,
participation at charter schools, visiting after-school programs, and having a presence at
community events to provide screening for as many students as possible. The club established
the “Share The Vision” program whereby an application may be submitted to the Vision
Committee for a comprehensive eye exam and a pair of prescription eyeglasses. The Dania
Beach Lions Club has partnered with Dania Eye Center to provide services and glasses at cost
and the Club pays for the exam and glasses. The club is planning future fundraisers like
“Moonlight Car Show” to accommodate an expected increase in applications for the “Share The
Vision” program."
MLK PARADE & CELEBRATION:
The requested event will be held at CW Thomas Park located at 100 NW 8th Ave, Dania Beach,
FL, 33004. This is a free event that is open to the public. This annual event will begin with a
breakfast inside the facility at CW Thomas Park beginning at 7:00 AM, followed by a parade
going to Frost Park at 9:00 AM and will conclude their celebration with the MLK Renaissance
Corp will host a gathering at the Frost Park Community Center with free food, live music,
bounce houses and more activities for the community to enjoy.
BLUERIDGE TREE FARM:
The requested event is an annual Christmas Tree Sale that takes place at 4650 sw 30th ave Fort
Lauderdale, FL 33312. Blueridge Tree Farm will be selling Christmas tree and wreaths for the
Christmas holiday. The Christmas tree sell has taken place from December 1999 to present.
Budgetary Impact
Moonlight Car Show:
Requesting for the following fees to be waived:
$388 for one Fire Inspector (4hr min)
3 deputies from 5:30pm-10:30pm would be $1,110. (15hrs x $74/hr = $1,110)
Adam Rosado Gas leak test $450
The special events application fee of $150
MLK Parade & Celebration:
The special events application fee of $150
BSO costs to be waived
Building permit fees to be waived
Blueridge Tree Farm:
The special events application fee of $300
Recommendation
The Parks & Recreation Department is recommending that the City Commission approve the
special events application request with the conditions noted above.
MOONLIGHT CAR SHOW:

BSO Fire: A Fire Inspector overtime will be require for a 4hr detail to inspect the
trucks & food vendors along with the tent set ups, and also a gas
contractor will need to perform the gas drop test.
Building Official Permits for Electric, Plumbing, and Fire are required.

BSO Police Dept. BSO has reviewed the application. Due to the alcohol sales,
road closure, and expected attendance. I recommend 3 detail
deputies for Law Enforcement services during the event. I
suggest they are hired from 5:30pm-10:30pm, so deputies are
there 30 mins before the event starts and remain 1 hour
afterward for the breakdown of the event and to clear out
traffic.

Your Event may require Security and Emergency Services which will be determined using this application,
your Site Plan and Narrative. MOT, transportation plan and any additional information requested during
your Special Events meeting. The hourly rate and costs for services will be quoted on the “Cost Estimate”
worksheet developed at the meeting and provided to the organizer. The cost may change after the meeting.
POLICE
Your event may require security services based on expected attendance and other risk factors such as
alcohol, time, day, location, event type of weather. Depending on your event, it may be possible to
supplement some of the Police services with a private third-party security company if their security plan is
approved by the BSO Police Department. If you want to use a private security company, their proposed
security plan must be presented along with their business license and contact information with this eve nt
application. The Police will review the plan and inform you if it meets City requirements.
BSO DETAIL REQUIREMENT
Based upon anticipated attendance, site or building size, site location, and ability to assure public safety
requirements, a Broward Sheriff’s Office detail may be required.
FIRE WATCH REQUIREMENT
A fire watch may be imposed depending on the type of event, number of persons present and/or hazards
involved. The number of personnel and apparatus required may vary depending on the type of event and
hazards involved. Below are the current rates charged for the presence of a fire watch detail and/or fire
inspector:
Off-Duty detail assignment services performed by Dania Beach Fire Rescue Personnel will be paid
at their current overtime rate of pay with benefits (3 hour minimum). In addition, an administrative
fee of 10% will also be charged based on the total cost of personnel and apparatus. Personnel costs
are currently estimated to be $84.42 per hour, per person (3 hour minimum).
The cost of apparatus is as follows:
Rescue Truck - $32.00 per hour
Engine (1500 gpm) - $17.00 per hour
Ladder (1500 gpm) - $80.00 per hour
The City of Dania Beach requires payment 14 days in advance for the detail services and fees are to be
made payable to the City of Dania Beach by means of cash advance or a cashier’s check. Fees are based
on individual employee’s overtime rates which vary from person to person. The amount estimated is based
on the highest overtime rate currently payable in addition to fees for FICA, Medicare, Worker’s
Compensation and Administrative fees. In the event that the entire estimated amount is not required for
services, the City will refund the money, less the expenses incurred for the service. Should the amount of
time required for the fire watch detail exceed that agreed up before the event, the Event sponsor will be
required to pay for any overage based on the actual cost for the fire watch. The Event sponsor will be
responsible to pay the actual service price incurred.
The information I have provided on this application is true and complete to the best of my knowledge.
If I have not submitted my application with the necessary plans, within the deadline and according to the
rules outlined in the Special Events Ordinance, it may be denied.
Before receiving final approval from the City Commission, I understand that I (and the production
company, if applicable), must furnish an original certificate of General Liability Insurance naming the City
of Dania Beach as additionally insured in the amount of at least one million dollars ($1,000,000) or greater
as deemed satisfactory by the City Risk Manager, and an original certificate of liquor liability insurance in

I understand that the City of Dania Beach sponsored activities have precedence over th e event requested
above and I will be notified if any conflicts arise.
I understand that the BSO Police Department will determine all security requirements and that the BSO
Fire Rescue will determine all fire and Emergency Medical Services requirements.
I understand that any cancellations for City scheduled services must be made by phone to each department
representative at least 24 hours before the scheduled event time or the organizer will be liable for any
associated fees.
I understand that the City has a noise ordinance that my event must follow. I agree to abide by all provisions
of the noise control ordinance and understand that my failure to do so may result in a civil citation, a
physical arrest, or the shutting down of the event. If at any time during the event it is determined by law
enforcement personnel, code enforcement personnel, parks and recreation personnel, or any other City
representative that the entertainment or music is causing a noise disturbance, I will be directed to lower the
volume to an acceptable level as determined by City staff. If a second noise disturbance arises during the
event, I may be directed to shut down the music or entertainment for the remainder of the event.

Request:
The Public Services Department (PSD) requests the adoption of a resolution authorizing a
memorandum of understanding (MOU) between the City of Dania Beach (City) and the Broward
Sheriff’s Office (BSO) to administer the FY21 Justice Assistance Grant (JAG) Program.
Background:
Several cities in Broward County annually apply for and receive United States Department of
Justice (DOJ) grant funds from the JAG Program. Those cities where BSO provides law
enforcement services enter into a MOU to administer the JAG Program. The DOJ awarded
Broward County, as the lead agency, JAG Award No. 15PBJA-21-GG-01376-JAGX for FY21,
for which the City as a sub-recipient receives $17,684.00.
The City expends its allocation on a share of a crime analyst position at BSO and specialized
crime prevention activities throughout the city.
Budgetary Impact
The MOU has no fiscal impact on the City.
Recommendation
PSD recommends that the City Commission adopt a resolution to enter into an MOU between
the City and BSO to administer the FY21 JAG Program.

WHEREAS, the City of Dania Beach (City) is eligible to receive funding from the United

WHEREAS, the DOJ has identified Broward County as a “disparate” county; and
WHEREAS, the DOJ awarded Broward County, as lead agency in the disparate county, a
JAG Award No. 15PBJA-21-GG-0376-JAGX for FY21, which the City as a sub-recipient was
awarded Seventeen Thousand Six Hundred Eighty-Four Dollars ($17,684.00) in funding; and
WHEREAS, on September 23, 2019, the City of Dania Beach City Commission approved
Resolution No. 2019-114 authoring a subgrant agreement with Broward County for the distribution
of FY21 JAG funds; and
WHEREAS, BSO has been selected through this MOU to administer the program and
serve as the fiscal agent for the distribution of all funds received for the JAG Program; and
WHEREAS, the City and BSO desire to memorialize the terms under which BSO will
administer the JAG Program and serve as the fiscal agent as detailed in the MOU, and which is
attached as Exhibit “A” and is incorporated into this Resolution by this reference.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1.That the above “Whereas” clauses are ratified and confirmed, and they are
made a part of and incorporated into this Resolution by this reference.
Section 2.That the City Commission of the City of Dania Beach, Florida authorizes
the proper City officials to execute an MOU between the City and BSO for FY21 JAG Program
and to execute any subsequent amendments to the MOU.
Section 3.That all resolutions or parts of resolutions in conflict with this Resolution
are repealed to the extent of such conflict.

WHEREAS, Broward County has been identified as a “disparate” County; and
WHEREAS, the participating agencies have been identified as eligible jurisdictions able to collectively implement the objectives and goals of the Edward Byrne Justice Assistance Grant (hereinafter “JAG”); and
WHEREAS, the participating agencies have formed a working committee and developed a course of action to achieve the goals and objectives of the JAG Program; and
WHEREAS, Broward County has been selected as through this MOU, to receive the grant funds, administer the program and serve as the fiscal agent for the disbursement of all funds received for the JAG Program; and
WHEREAS, Broward County has entered into a subgrant award agreement with BSO and subrecipients of the 2021 Edward Byrne Justice Assistance Grant. There are various terms and conditions BSO will be requiring the participating agencies to enter a Memorandum of Understanding agreement to properly allow BSO to take the lead in the administration of this grant; and
THEREFORE, in consideration of the mutual terms, conditions, promises, and covenants hereinafter set forth, the participating agencies agree as follows:

Purpose
This MOU establishes the relationship between the parties for participation in the FY 2021 Edward Byrne Justice Assistance Grant (JAG) Local Solicitation Grant Program (Award Number _15PBJA-21-GG-01376-JAGX).
Procedures 1. Broward County will serve as the grant administrator for the agencies in Broward County, Florida participating in the JAG Program. Pursuant to the JAG Program guidelines, funding for the JAG Program will be provided to BSO. 2. On or about July 28, 2023, Broward County has entered into a subgrant award agreement, with BSO which authorizes BSO to serve as the lead agency in administering the grant on behalf of Broward County, through its Addendum to Subgrant Award Agreement Between Broward County and the Sheriff of Broward County for Administration of the FY21 Edward Byrne Memorial Justice Assistance Grant, entered on May 15, 2024 and attached hereto and incorporated herein by reference as Exhibit A. 3. The BSO will enter into a Memorandum of Understanding with participating agencies to allow BSO to provide the administrative services required of Broward County and to facilitate compliance with the required conditions of the Grant 4. The BSO will monitor implementation, reporting, and payment requests from participating agencies. BSO shall confirm the accuracy of program activities and expenses. Upon review of participating agencies’ payment requests, BSO shall forward approved reimbursement requests to Broward County for payment. Broward County will disperse the funds directly to participating agencies. 5. For participating agencies that currently contract with BSO for law enforcement services, the BSO shall pay the payroll expenses and seek reimbursement from the participating agency. The BSO shall invoice the CITY for the cost of the Services incurred and being provided to City pursuant to the Grant Award. The City shall pay the invoice within thirty (30) days of receipt of SHERIFF’s invoice. Payment to SHERIFF is not contingent upon COUNTY reimbursement to CITY. BSO acknowledges that Grant funds may not, under any circumstances, be expended prior to October 1, 2020 or after September 30, 2025 (“Eligible Period) or if the Grant term is extended, through the extension date. BSO agrees it will not seek reimbursement of any costs or expenses other than those incurred during the Eligible Period. City shall have no obligation to reimburse BSO for any amounts for costs or expenses not incurred during the Eligible Period.

6. Each party has submitted its own application for their individual JAG Program to the BSO. The BSO Grants Management Office has worked, and will continue to work, in collaboration with Broward County to prepare the single application to include the Program Narrative and Budget Narrative, and Broward County shall submit the application to the Department of Justice. 7. Participating agencies must submit Quarterly Project Performance and Financial Reports to BSO within fifteen (15) days after the end of the reporting period. In addition, if the performance period is extended beyond the “original” project period, additional Project Performance and Financial Reports must be submitted. 1. This MOU shall remain in effect from October 1, 2020 through September 30, 2025, and its continuation shall be subject to the availability of necessary funding from the JAG Program. 2. A participating agency may withdraw from this agreement at any time by providing thirty (30) days written notice of its intent to withdraw to each party. 3. This MOU may be terminated upon the written consent of all parties to this MOU.
Amendments This MOU may be modified at any time upon the written agreement of each party.
Insurance and Indemnification
1. Each party agrees to maintain its own comprehensive general liability insurance, professional liability insurance, automobile liability insurance and workers compensation insurance policy or maintain a self-insuring fund for the term of the Agreement in the amounts determined by each party to adequately insure said party’s liability assumed herein, but in no event shall such coverage be less than the amount of statutory waiver of sovereign immunity. The participating agencies agree to provide BSO and/or Broward County within thirty (30) days of entering this Agreement with proof of insurance if requested. 2. Each party shall be responsible for the negligent acts or omissions of their respective employees in accordance with Ch. 768.28, Fla. Stat. and nothing herein shall be deemed a waiver of those protections.
Guidelines In performing its duties, responsibilities and obligations pursuant to this Agreement, each party agrees to: (i) adhere to the requirement standards set forth in the Office of Justice Programs’ Financial Guide, as amended and Federal OMB Circular A-133, as applicable; and (ii) , the special conditions FY 2021 Edward Byrne Justice Assistance Grant (JAG) Local Solicitation Grant Award issued by DOJ.

Each party shall maintain its own respective records and documents associated with MOU sufficient to demonstrate compliance with the terms of this Agreement for a period of five (5) years from the date of execution of the MOU and shall allow BSO and/or Broward County access to such records upon request. c. Each party, its employees or agents, shall allow access to its records concerning this MOU at reasonable times to BSO and/or Broward County, its employees, and agents. The term “agents” shall include, but is not limited to, auditors retained or employed by BSO and/or Broward County. The term “reasonable” shall be construed according to the individual party circumstances but ordinarily shall mean during normal business hours of 8:00 am to 5:00 pm, local time, Monday through Friday. d. Upon reasonable notice, the participating agency shall provide BSO and/or Broward County with any additional documentation, information, or reports as may be required by BSO and/or Broward County.
Execution
This agreement may be executed in counterparts each of which shall be deemed an original and all of which together shall be considered one and the same agreement.

BROWARD COUNTY STANDARD SUBGRANT AWARD AGREEMENT '
This Broward County Standard Subgrant Award Agreement ("Subgrant Award
Agreement") is made and entered into by and between Broward County, a political subdivision
of the State of Florida ("County"), and the Sheriff of Broward County, Florida, a constitutional
officer of Broward County ("BSO"). County and BSO are individually referred to as a "Party" and
collectively as the "Parties."
Recitals
A. Co~nty has received a grant award from the Awarding Agency and in the amount
specified in the Subgrant Award Details, pursuant to the grant attached as Exhibit A ("Grant").
B. The Grant permits County to distribute Grant funds to third parties that will
implement the Grant as described in the Program Narrative referenced in Exhibit B.
C. BSO desires to accept a subgrant from County of funds awarded under t~e (irant,
which shall be utilized by BSO in accordance with the Grant and this Subgrant Award Agreement.
For good and valuable consideration, the receipt and s~fficiency of which are hereby
acknowledged, the Parties agree as follows:
1. Recitals. The recitals stated above are true and correct and are incorpo~ated herein by
reference.
2. Standard Subgrant Award Terms and Conditions. By signing this Subgrant Award
Agreement, BSO represents that it has read the Grant (Exhibit A) and County's Standard Subgrant
Award Terms and Conditions ("Subgrant Award Terms") (available online at
http://www.broward .org/GrantTerms) and understands all obligations and requirements of the
Grant. The Subgrant Award Terms are incorporated herein as if fully set forth in this Subgrant
Award Agreement.
3. Subgrant. Award . BSO will implement the program(s) described in BSO's Program
Narrative (Exhibit B) in accordance with this Subgrant Award Agreement and will comply with the
provisions stated in the Subgrant Award Details in Section 8 . In consideration for BSO's
performance and compliance with this Subgrant Award Agreement, including the Subgrant
Award Terms and the Subgrant Award Details, County will provide the Subgrant Award Amount
stated in the Subgrant Award Details. ·
4. Funding. The maximum amount payable to BSO under t~is Subgrant Award Agreement is
the Subgrant Award Amount specified in the Subgrant Award Details and more specifically
described in the Subgrant Program Budget attached as Exhibit C. BSO shall invoice County in
accordance with the Invoicing Schedule stated in the Subgrant Award Details.

5. Modifications. BSO must submit any proposed modifications to the Program Narrative or
the Subgrant Program Budget in writing to County for approval. BSO may not deviate from the
Program Narrative or Subgrant Program Budget without prior approval from County (and from
the Awarding Agency, if required by the Grant).·
6. Reporting Obligations . BSO represents and certifies it has reviewed the requirements in
the Grant, the Subgrant Award Details, and the Subgrant Award Terms regard i ng the
documentation, reports, and other information that must be provided by BSO to County
(collectively, "Reporting Obligations"). BSO shall strictly comply with all Reporting Obligations ,
including time being of the essence .
7. Term . The duration of this Subgrant Award Agreement ("Term") shall be the Project
Period stated in the Subgrant Award Details, as may be extended by the Awarding Agency .
