Services and Artwork Agreement
This is a contract that documents our agreement, as follows:
1. Who: City of Dania Beach (Client) agrees to hire Ken Mullen (Artist) to create chalk/tempera artwork.
2. What: The subject and details of the artwork include: Dania After Dark__
3. When: The work will begin on January 13, 2024 , or on the next mutually agreeable date.
4. Where: The artwork will be created at 100 Dania Beach Blvd, Dania Beach, FL 33004 . You represent that you have
the authority to retain me for this purpose.
5. How Much: You agree to pay me a Fee of $1,100 for the artwork. This includes all travel, time, and materials.
Deposit and Final Payment: A non-refundable design fee of n/a is due with this signed contract. This amount is
applied as a credit towards the total cost of the project. The outstanding balance is due in full within 30 days (NET30) of
the completion date of the contract.
Change Orders: If you would like to change the scope of the project after we sign this contract, the cost of the project will
also be revised. We can agree to the new price by sending a confirming email, or we can amend this contract.
Cancellation: Because I may have turned down other work in order to keep my commitment to you, the following
cancellation terms apply:
If the Client cancels the performance and notifies the Artist in writing with at least 24 hours’ notice, the Artist will
receive $250 plus $100 for specialty supplies ($350 total) associated with this job. If the performance is cancelled and
the Client notifies the Artist in writing with at least 12 hours’ notice, the Artist will receive $250 plus $100 specialty
supplies fee, and a $100 cancellation fee ($450 total), and the Client is not liable for the remainder of the balance. If
the performance is cancelled with less than 12 hours’ notice, the full payment remains due.
6. Other Important Stuff:
Rain is an inherent risk when creating artwork outdoors and you are assuming this risk. Thus the balance of payment
remains due, without reduction or contingencies even if the artwork is not completed or the event is rained out. I agree to
bring materials to cover and secure the area in case of rain, within reasonable limits. I will do everything within my power
to salvage the artwork in case of rain during the event. If rain washes out the event within the last 4 hours of the event, the
work will be left to the elements.
You are responsible for removal of artwork, including any cleaning of the asphalt/concrete after the event, if necessary.
Some Things that I Guarantee; Some Things that I Don’t: You are hiring me because you have seen some of my other
work, either in person or on my website. While I am working on your project, I guarantee you that I will give it my full
artistic attention and effort in an attempt to create the final image as agreed upon. However, as much as I want you to be
100% satisfied with the artwork that I create for you, I cannot guarantee that this will be the case. Thus, upon completion
of the artwork as described above, the balance of payment remains due, without reduction or contingencies in the event
that it does not turn out exactly as you anticipated.
