Any major deviations or updates to the itinerary may result in additional fees. Clients are responsible for the full amount of hours used for any hourly priced charters regardless of prepayment status or approved Purchase Orders received prior to the charter. For all overnight, multi-day trips the customer is responsible for providing hotel accommodation for their driver for the entirety of their trip unless otherwise specified in your contract. Additional fees of $250 per night will be incurred in the event that FloridaTours.com needs to provide hotel accommodation. In the event of special circumstances when a specific bus permit or parking permit is needed for the charter, these additional parking/permit fees are the responsibility of the customer. FloridaTours.com will not check any luggage, baggage or personal property (collectively, the Personal Property). FloridaTours.com will not be responsible for any loss of or damage to any Personal Property due to any reasons whatsoever and Charter Party hereby waives any claims it may have against FloridaTours.com regarding same. All Personal Property must easily fit in the overhead or under- seat passenger baggage area or otherwise stored in the luggage compartments under the vehicle or in the back compartments. Storage space is subject to availability. The right to accept or refuse any item of Personal Property is the sole discretion of FloridaTours.com personnel. Payment Policy: Prohibited Items: Payment for charters is due in full 14 days prior to the 1st date of the charter service. Payment is accepted via credit card, company check, cashier’s check, money orders, ACH payments, and cash. All credit card payments will incur a 4% processing fee. Returned payments will be assessed with a $50 return fee. The following items are strictly prohibited: firearms, ammunition, any hazardous, caustic, radioactive or flammable material of any kind, any item emitting an unpleasant odor, any biohazard of any kind, any knives or other kind of weapon, any item as described by any state or federal law as being illegal, any item that may cause damage or harm to a person or property, and alcoholic beverages. Flash photography is prohibited while the vehicle is operating. Smoking of cigarettes, e-cigarettes, cigars, or pipes is prohibited aboard the vehicle. Please reference Oxygen and Respirators clause below for additional terms.Cancellation Policy: Smoking Policy:100% of the charter fee will be assessed for charters cancelled within 48 hours of the scheduled trip date.Smoking of cigarettes, e-cigarettes, cigars, or pipes is prohibited aboard the vehicle.Gratuity: Food & Beverage Policy:A gratuity is not included in your price unless specifically noted in your contract. Gratuity is optional and is at your discretion. The most common gratuity amount is 5% - 10% of the total fare. We are able to add gratuity to your contract if preferred, but we always recommend giving gratuity directly to the driver. No food or drinks are allowed to be consumed while on the vehicle(s). Overnight Charters: Pet Policy: Customers are responsible for booking and providing single room lodging for all vehicle driver(s) throughout the duration of any overnight trip. If FloridaTours.com is required to provide lodging for vehicle driver(s), a $250 per night additional lodging fee will apply. We recommend providing a room in the same hotel your group will be staying in. All animals are prohibited from boarding the vehicle except for service animals in compliance with the Americans with Disabilities Act, specifically 28 C.F.R. § 36.104. All service animals are the sole responsibility of the owner and must be in control with a leash, carrier, or other appropriate restraints. Any damage to the vehicle or clean up required is to be paid by Charter Party. Service animals cannot travel in the aisle or occupy a seat that may otherwise be available to other passengers. Any animal considered a threat to the health or safety of other passengers or employee personnel will not be transported.Cleaning Fees: Dress Code: If the vehicle(s) is/are not clean and free of litter at the end of the trip, a cleaning fee of $250 may be assessed for each vehicle. The cleaning fee will automatically apply for any cleaning due to bodily fluids.For the comfort of all customers, proper attire is required. Shirts and shoes are required at all times. Bathing attire must be covered. Body paint, excessive suntan lotion/oil, and glitter is highly discouraged. In the event special cleaning of the vehicle after completion of the charter is needed due to body paint, suntan lotion/oil, or glitter, a $250 cleaning fee may be assessed. The driver must be given eight (8) consecutive hours off before resuming duties. An additional driver may automatically be required depending on the charter itinerary and required drive time. Additional fees may be necessary if an additional driver is required for the charter. FloridaTours.com will not risk the safety of their drivers or passengers and a second driver requirement is non-negotiable when required to remain compliant per DOT regulations. If assistance is required for boarding please notify FloridaTours.com at the time of booking to secure an ADA vehicle. If boarding assistance is required and was not requested in advance or provided, FloridaTours.com will make a reasonable effort to accommodate customers so long as it does not jeopardize the safety of the passenger and/or delay the scheduled departure time. COVID-19 Policy: Mobility Aid Devices: WAIVER of LIABILITY -- The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is reported to be contagious. The state of medical knowledge is evolving, but the virus is believed to spread from person-to-person contact and possibly by contact with contaminated surfaces and objects or in the air. People reportedly can be infected and show no symptoms and therefore spread the disease. The exact methods of spread and contraction are unknown, and there is no known treatment, cure, or vaccine for COVID-19. Evidence has shown that COVID-19 can cause serious and potentially life-threatening illness and even death. FloridaTours.com cannot prevent you [or your child(ren)] from becoming exposed to, contracting, or spreading COVID-19 while utilizing FloridaTours.com services or premises. It is not possible to prevent the presence of the disease. Therefore, if you choose to utilize FloridaTours.com services and/or enter onto FloridaTours.com premises you may be exposing yourself to and/or increasing your risk of contracting or spreading COVID19. ASSUMPTION OF RISK-- I have read and understood the above warning concerning COVID-19. I hereby choose to accept the risk of contracting COVID-19 for myself and/or my children in order to utilize FloridaTours.com services and enter FloridaTours.com premises. These services are of such value to me [and/or to my children,] that I accept the risk of being exposed to, contracting, and/or spreading COVID19 in order to utilize FloridaTours.com services and premises in person. WAIVER OF LAWSUIT/LIABILITY-- I hereby forever release and waive my right to bring suit against FloridaTours.com and its owners, officers, directors, managers, officials, trustees, agents, employees, or other representatives in connection with exposure, infection, and/or spread of COVID-19 related to utilizing FloridaTours.com services and premises. I understand that this waiver means I give up my right to bring any claims including for personal injuries, death, disease or property losses, or any other loss, including but not limited to claims of negligence and give up any claim I may have to seek damages, whether known or unknown, foreseen, or unforeseen. Passenger mobility aid(s) may travel inside the vehicle if they are able to be safely stowed in the overhead compartments. Items that cannot be safely stowed in the vehicle will be stowed in the baggage compartment if possible. Florida Tours.com assumes no liability for damage to these devices. Lost Personal Items: FloridaTours.com assumes no liability for lost items under any circumstances. All inquiries for lost articles transported in the custody of a passenger should be made within 48 hours to info@floridatours.com or by contacting 954.637.1933 to report your lost item. Reasonable efforts will be made to locate the item. If the item is in FloridaTours.com possession, the item may be picked up locally or a $50 service fee + the total cost of shipping will be assessed to ship any lost and found items. Entertainment Equipment: Vehicles may be equipped with DVD, CD player and may have a working PA system, TVs, USB charging ports, and other amenities. Vehicles may also be equipped with Wi-Fi. Equipment size, function, and availability is never guaranteed. No refunds will be given for non-working equipment. Other Disclaimers: RIGHT TO SUBSTITUTE VEHICLES FloridaTours.com reserves the right to substitute vehicles and, when necessary, sub-charter or subcontract a vehicle to complete the agreed upon trip. OBJECTIONABLE PERSONS FloridaTours.com reserves the right to refuse to transport any person if it believes that person's conduct is likely to be objectionable to other passengers or FloridaTours.com personnel. An example is a person that FloridaTours.com believes is under the influence of alcohol or drugs.
