No other work is promised or implied. All material is guaranteed as speciﬁed in this contract. Owner is entitled to a completely ﬁlled in copy of this contract signed by both parties before work may be started. Aluminum and Fiberglass windows and doors can take between twelve (12) and ﬁfteen (15) weeks. Installation normally commences within one to two (2) weeks of product delivery and permit approval at a date suitable to both Owner and Shutter Brothers LLC. Upon completion of the work, Shutter Brothers LLC will remove debris, surplus material, and old windows and doors from Owner's property and leave it in a neat and broom-clean condition 1. Connection or reconnection of alarm systems: Removal of existing alarm systems and sensors are the responsibility of the owner. Shutter Brothers LLC representatives are not responsible for the reconnection of any sensors or alarm systems. 2. Shutter Brothers LLC shall be responsible for repairing stucco ﬁnish around proposed windows and/or doors, unless otherwise indicated under additional details in this contract. All painting after the completion of the services described in this contract is the responsibility of the homeowner. (Customer's Initials) 3. Installation & Procedures: According to county product approval the threshold/sill of an Impact Door has a standard height of 1.50", this sill may protrude above the interior tile in some installations. In accordance to the building code all doors must be centered to the block of the home, causing a gap in the interior tile between the door and where the existing tile was ﬁnished, any tile work is not the responsibility of Shutter Brothers LLC. Shutter Brothers LLC is not responsible for repairing or ﬁxing any tile in the vicinity of door being replaced in the event of a tile cracking or breaking. Shutter Brothers LLC is not responsible for replacing or ﬁxing any broken window sill, it is the homeowners responsibility to replace in the event any breaking when removing the existing windows or installing new window. All installations are to be done in accordance to county product approvals and manufacturer product installation instructions deemed satisfactory by a county inspectors. Procedures, installation & window measurements are subject to change based on Shutter Brothers LLC and its representative’s good judgement. (Customer's Initials) 4. Permits, if required, will be obtained by Shutter Brothers LLC, Home owner agrees to pay the fee set by Shutter Brothers LLC. which will be written in the signed contract as a separate line item. If Homeowner refuses to obtain a permit for the work, he or she must sign "Refusal of Permit" form provided by Shutter Brothers LLC, stating that homeowner is responsible for all ﬁnes and fees placed by the county. 50% balance will not be due until the permit pulled by Shutter Brothers LLC is approved and closed by the county. Home Owner’s Association approval – If approval is necessary, Owner agrees to excuse Shutter Brothers LLC for any delay in installation pending Home Owner Association approval however, in the event that Owner is unable to perform these tasks, Shutter Brothers LLC may elect to do so. Please arrange with Shutter Brothers LLC prior to installation if you need assistance. (Customer's Initials) Any changes, alterations or deviations to this contract must be made in writing. In the event of such changes, a written change order must be executed. Extra work and Change Orders become part of the contract once the order is prepared in writing and signed by the parties prior to the commencement of any work covered by the new Change Order. The order must describe the scope of the extra work or change, the cost to be added or subtracted from the contract, and the effect the order will have on the schedule of progress payments Shutter Brothers LLC is excused for any delay in completion of the contract caused by acts of God, acts of the Owner or the Owner's agent, inclement weather, wet or muddy grounds, labor trouble such as strikes, accidents or delays beyond Shutter Brothers LLC's control, acts of public utilities, public bodies, county permitting, acts of the home owners associations or its representative, inspectors, extra work, failure of the Owner to make initial payment promptly, or other contingencies unforeseen by Shutter Brothers LLC and beyond the reasonable control of Shutter Brothers LLC. Shutter Brothers shall carry general liability insurance for the scope of work described in this contract. In the event Shutter Brothers LLC deems it necessary to ﬁle a mechanics lien or to ﬁle suit to collect any money due under this contract, not resulting from a legal dispute as to Shutter Brothers LLC's performance of this contract, Owner agrees to pay all Shutter Brothers LLC's costs of collection and legal fees including reasonable sums incurred by Shutter Brothers LLC for attorney's fees. If the parties become involved in legal action resulting from a dispute as to Shutter Brothers LLC's performance of this contract, the court shall award reasonable costs and expenses, including attorney's fees, to the prevailing party.
